Dear [Your Rep's name]
http://articlevprojecttorestoreliberty.com/index.html
This is a project to repeal the 14th 16th and 17th amendments restoring the Original Constitution limits on Government at the Federal level and restoring States Rights - Liberties and unlimited powers. The Constitution is a limit on the Federal Government and does not include any language that extends the powers outside of Article I section 8. The Federal Courts are limited to Article III approved actions - they do not have the powers of Judicial Review, to determine if a law is Constitutional, these are issues for the State courts to decide, Only items in Article I , 2, 3, 4, 5, 6, and 7 as shown below.
We either support the RULE - BY - LAW or we have no Constitution at all - the ORIGINAL CONSTITUTION SAID WHAT IT MEAN AND MEAN WHAT IT SAID in the meaning of the words at the time of writing and adoption - no language is included to allow courts, or legislative acts to modify, alter, interpret, modernize, fill in imagined voids, the Founders - Framers and Ratifiers were very well educated people that spoke many languages but chose to use simple uncomplicated words that as they said could be read and comprehended by the average person of the times . . I guess our education system is failing the citizens.
Please feel free to use the large Constitutional - American History library on the site, if we can be of further use please contact us. WE support the use of Article V and the use of a REPEAL amendment [like the 21st repealed the 18th] - there is no risk as each State legislature would vote on the proposed 20 word 28th amendment.
Respectfully,
[Your name]

We either support the RULE - BY - LAW or we have no Constitution at all.
The ORIGINAL CONSTITUTION SAID WHAT IT MEANT AND MEANT WHAT IT SAID. The meaning of the words at the time of writing and adoption, the definition in context is vital to understanding. There is no language included that allows courts, or legislative acts to modify, alter, interpret, modernize, fill in imagined voids.
The Founders - Framers and Ratifiers were very well educated people, they spoke many languages, but chose to use simple - uncomplicated words, that could be read and comprehended by the average person of the times .

Article V (5), the Constitutional process. The proposed 28th amendment, does not amend and add - it repeals and restores the Constitution of the United States.
We the People, living in our respective States must act. We must return to trusted and responsible government, government that we can trust, responsive and dependent upon our own Constitutional reliance and the elected legislatures of our States. We CAN make the difference, and we are trusting you to rise up with us, to effect exactly that.

It's all there:
Ready, for the representatives to take back to their States. One amendment, 20 words that will restore our sovereignty and our Constitution. We do not propose to add more 'fixes' and new legislation that might bog down with debate and cost any more valuable time.
We cannot afford to waste/or lose any more.

May I Address You, Fellow Citizens
America is in serious jeopardy of becoming a Pure Democracy without the protection of a Constitution!
The 235 year old Constitution is being attacked from all sides - the Extreme left calls it a 'Living document', a Document of legal structure and not law, a outline to be filled in by Congress and statute laws; as time and the political fortunes and popular winds might blow it. How has that thought system been working for the people, I ask?
Are we not seeing our rights and liberties being reduced each and every year, as the three [federal] branches just basically ignore any limits stated in the original Constitution. The Congress says it can pretty much do as it pleases,... if it can pass the law.
The Executive now says he will do as he pleases as he has a phone and pen to sign Executive orders. The Courts have such narrow limits, concerning who and when, We The People or our representatives can not bring suit against the other branches of government. 'Standing' is a court invention and Judges can find it open to interpretation, especially if, the applicant is of liberal philosophy. A perfect example is an environmentalist group vs. an Industry or group of businesses. The Courts favor championing these cases and casting opinions in favor of this popular 'progressive' agenda. Then as the political landscape changes, perhaps the Next Judge or Court could be more conservative and say 'no' to the Environmental group, and say 'yes' to the Industry and businesses. The laws being made by current politics and changing standards, instead of true, fair, unprejudiced, and permanent Constitutional standard.
Clearly the government is out of control, and has changed to no longer respect The People's right to property - THEY take our property, while violating the "TAKING" clause of the fifth amendment, themselves. The THIEF is the Master, no longer a subject of the laws, but the 'violator' above them. Farmers can no longer farm their land, or sportsmen access public and federal lands, if an endangered species [weed, insect, lizard or even a non-native fly] is said to have been seen on the land.
Environmentalists found some small fish, and sued to cause the shutdown of irrigation in the California central valley - the government had contracted with the farmers to provide the irrigation water, and now using environmental activism and a fish, they break the contract. Many farmers lost their farms and were forced into bankruptcy - their legal rights were violated without just compensation. We The People were usurped by a fish.
Children in large city, the ghettos have had Government take away the vouchers that permitted their children to escape a collapsed and failed central city school system. The Federal government sued to stop Louisiana from issuing vouchers, to mostly black students ironically, many of the most impoverished, vouchers that would have allowed that they could go to better schools. How much sense does it make to force children to attend schools that can not educate them or provide them with skill sets that would allow them a opportunity to find gainful employment.
Job skills are not taught in most schools any more. Increasingly, we can see that the young can not find employment, either in jobs that require education skills, but also, as they have no trade or specific training to qualify them. Yet the federal government continues to demand more tax dollars to throw after the failing public school systems they have been socially engineering for decades.
Our failing social 'net' programs have failed us too, and have created a sad paradigm, young women choose to have babies out of wedlock so they can qualify for all the welfare monies available, like Food Stamps, housing allowance, Medicaid, school meals [3 per day] and afterschool free child care at schools.
"The steady expansion of welfare programs can be taken as a measure of the steady disintegration of the Negro family structure over the past generation in the United States." Daniel Patrick Moynihan. He was correct, the rules stated to qualify for help, the husband or man could not live with the family. How stupid was that in retrospect? We do not address education or training programs that target and specifically aid these mothers in a trade that can help her support her family; help her to leave the condition of reliance and break the cycle of poverty - proven through generations to perpetuate itself.
A further failure of the many public welfare programs for the unemployed person, if they do any work outside of their 'assistance' they could lose their welfare benefits that exceed the small earnings allowed. I have a common sense suggestion, how about if we encouraged them to work and let them reduce the amount of welfare money they can collect by 25% of the earned amount? Yes - reward them for work! Help them move up the economic ladder, build a skill set and self esteem and establish the concept of self-reliance and independence.
Consider the possibility, Could it be that the big city politicians want to keep control over the people and use them as voter farms? Yes, it is possible that people are being used, through encouraged dependency and perpetuating poverty and 'needy populations' for others to get and keep POWER OVER them. Doing so, by never really correcting the problems, just paying lip service to them, blaming the other political party for the conditions they in a turn, insure through pretended action and empathy.
Our Representative Democracy, correctly the 'Republic' upon which we were founded, is gone. Representative government today is just not working any longer to Protect We the People from Oppression and Tyranny . . the Federal government has continued to raise taxes, fees, permits, fines and other money collection methods to collect so much money. Money, they in turn, use to bribe voter blocks, or hold hostage our city, State and local governments, so they must do the bidding of 535 elected officials in Washington, DC.
We see the foolish results of all these statutes, like 2400 pages of the ACA, 1500 page budget bills, no one reads these and they still pass them into laws which just do not work to benefit the citizens. [Inside of these massive bills they hide and attach many 'perks' for the special interests and/or added layers of more laws and regulation.
These mega laws benefit the Government, the layers and additions grow government agencies. The IRS, NSA, DOE, DOD, EPA and many other agencies have now proven that Congress can not even provide oversight. The agencies go rouge, their administrations conduct business without Congressional oversight, we have created a leviathan bureaucracy that cannot, and is not managed. Now we have an executive that says he only needs a pen and a phone to get past Congress to do as he wishes, executive orders are issued and used to punish industries and segments of our industrial base, they are used to promote and implement an agenda that cannot pass through the legislative process.
Americans seem to be numb to all the abuse. The 24/7 news cycle drones every usurpation to mediocrity, we are no longer capable of being shocked. Disillusionment is the state where we just say - "well I tried, but electing new people does not change a thing, they are all the same?"
In an attempt, by many Patriots, the ARTICLE V STATE AMENDMENT movement was born about ten years ago. Many have fought hard to educate the public that WE THE PEOPLE have the power to shut them down - we can end the Oppression and Tyranny from Washington. We are the People living in the States are the last line of defense, the wall, the brake applied to this over-reaching, out-of-control, usurping federal government.
We can take back the majority of the money, stop the borrowing of our great grandchildren's money and freedoms. We can, by acting through our State Legislatures, regain our rights and freedoms using Article V to repeal the 14th, 16th, and 17th amendments, which will restore States rights and power. It will make the Senators report to our State Legislatures, it will make the courts withdraw usurped powers and start to respect the Limits of Article III of the Constitution of the United States again.
Yes, fellow citizens we the people have the power to make government smaller, weaker and limited. The government that governs best is the one closest to the people. Local and State. Now the important questions come- "Are you mad enough to take action? Will you present ideas to your State legislators [all of them], and will you ask them to take Article V action to their legislative floor, and propose the Repeal Amendment found in the Article V Project to Restore Liberty Library?
Each citizen has a responsibility to help govern our States and Nation. Voting is a right. With our votes we choose the people we trust to represent us and be our voice. Raising that voice in defense of restoring our Founding Document and demanding action that will stop the federal branches from usurping and ignoring the Constitution, is a responsibility. Ours, We The People.

Things WE Need To Be Doing NOW, For the 2014 Mid-Term Elections!!
Posted by Mike on August 23, 2013 at 10:23am in Tea Party Nation Forum
I know that this will not sit too well with many of our members, and I do understand why they think the way they do about what I am going to say. That being said, I cannot see any advantage whatsoever in splitting our votes and squandering our unified strength like we did in LOSING the 2012 Elections so badly. I see where the lure of a Third Party or an Independent Candidate would have its avid supporters, but the FACT REMAINS that way led to FAILURE! If we want to win I also agree that we can no longer hold our collective noses and vote for the lesser of two evils. That way leads to FAILURE also.
So, we have no choice but to change the parties internally, and vote AGAINST the Progressives in both Parties. We can't afford to split our votes and lose again, It means no independent and no third party votes. We have to clean up the mess by getting our picked candidates on the tickets to run for office. Voting Third Party or Independent this time will spell disaster. I hope the third party or independent candidates see that they need to infiltrate either one of the two major parties and change it from the inside, if we are ever going to get back control of our Republic.
I know that we are becoming overwhelmed by the Saul Alinsky tactics of the Globalist Elites throwing everything they can think of against us and pushing the Panic Button on all of them to split our focus and unity. Remember, they are polished masters at those Communist/Globalist methods. We must of necessity have a two-pronged attack ready and fleshed out to seriously oppose their destructive agendas.
The way to restoration of our Republic will have to take two simultaneous paths. Both paths are critical to winning and the same attention to detail and commitment needs be done EQUALLY with both. We need to set hard and fast priorities on the most important issues facing us, and we need to take over control of the Primary Elections for all levels of government.
We do know that the Three most Absolutely Critical Issues are: Restrictive gun Control, Amnesty for Illegals, and Defunding the Affordable Care Act before it is too late. We know we have until Oct.1 and no later to have the defunding in place. We are also faced with the potential Ratification of the UN Small Arms Treaty which will strip Americans of their Second Amendment Rights if it becomes the Law of the Land. We know that our economy will be shattered if we allow all of the illegals in this country to have Amnesty and from that to overwhelm our Social services.
To do these things we need to continuously confront our Representatives and Senators while they are here Locally during the August Recess with face to face meetings, phone calls, at their town hall meetings. We need create a postcard blitz to their local offices, create a Fax blitz to their local offices, and the week before they return to Washington we need to start sending the postcard and fax blitz to their DC offices so they will have a multitude of protests to wade through. Don't be afraid to politely inform them they will lose their jobs in their next election if they don't follow our demands on the three most critical issues.
We need to do these things to gain control of the Primary Elections and get control at the polls in every District. We need to volunteer to become Precinct Captains, Precinct Chairs, Voter Challengers, Vote Counters Poll Watchers etc.
While doing this we need to vet the candidates we want to see run for office instead of who the party leaders want to put in through Cronyism. That means we will need volunteers to circulate petitions and get them signed by the required number of verified registered voters to get our picks on the ticket (this can be done for BOTH PARTIES to remove questionable politicians and put responsible candidates on the ticket). It also means we will need to energize voters to get out the vote and vote for whoever we want to run.
One other thing needs to be done with boots on the ground; we need to canvass our own neighborhoods and make sure everyone is registered to vote, able to get to the polls or we will have to provide rides, those that can't physically make it to the polls are signed up/registered for Absentee Ballots.
I have put this out for the last two elections but it seems people don't want to do these necessary things that groups of four friends in each district could easily do. This is absolutely the last chance to effectively oppose the Progressive/Globalist Agenda. If we lose this time, IT'S OVER!
In Search of Mr. Jefferson’s Liberty … Part 1
Posted on August 24, 2013 by Hans
I was asked to prepare a talk on the topic of “Jeffersonian Liberty” for Brock’s October PATCON. I decided to publish ahead of the gathering. Read and reflect at your leisure, as I may abstain from doing a formal talk. I don’t enjoy public speaking, but I do plan to be at the event east of Tarboro NC on Saturday 5 October. Permission to republish is granted IF AND ONLY IF the References list is retained in its entirety. This paper is a novel presentation of thoughts assembled from various authors. There is very little original content, but it is absent traditional formal footnotes to the sources in the References list. The welfare state and rules ‘malum prohibitum’ chafe upon our life, liberty and property. We seem to find easy agreement regarding things that offend us. The question “What binds us together” has been more difficult to address. Prior to the Spring PATCON, a small group of us met and failed to agree upon a formal explanation for the purpose of an armed Muster. |
That discussion led to conversation about the absence of an agreed description for a vision, a desired end-state that could be embraced by all in the liberty movement.
The meeting broke down over my proposal to adopt Jefferson’s’ definition of Rightful Liberty as the goal, the compelling vision for Patriots.
“Rightful Liberty is unobstructed action according to our will within limits drawn around us by the equal rights of others. I do not add ‘within the limits of the law’ because law is often but the tyrant’s will, and always so when it violates the rights of the individual.” ~ Thomas Jefferson
Rightful Liberty received more challenge than constructive debate. Objections were raised: the definition of liberty has evolved over time; our society is no longer a moral Christian people. While these observations are valid, they are a distraction. We cannot enforce the definition of a word any more than we can dictate religious doctrine to our neighbors. We must look for a solution that can work within our current circumstances.
We are individuals engaged in an outreach program – ‘organizers’ in the Patriot community. We are dealing with people who struggle to balance autonomy and community. A very real antagonism exists between liberty and authority.
Recently, a question arose over whether to include or exclude a particular ‘group’ at the PATCON. There was no clear criteria by which a decision could be made. Both the attendees and organizers wish to exercise free choice regarding associations.
Freedom, for a man in nature, is action according to his will regardless of outcome or consequence. Liberty is different. Liberty is action disciplined within a social context.
In conducting my research on Mr. Jefferson’s concept of liberty, I learned some things that were unexpected. I reached some conclusions that are hard to dismiss.
Situation:
Disunity and lack of cohesion is a survival problem for the Patriot community. Our isolationism is a natural consequence of “individualism”. Collectivism and tyranny are our ‘common enemies’. Attempts to “restore the Constitution” have failed to restore liberty. A compelling vision for a desirable end-state is absent.
An individual is a natural person, a human being, as opposed to a legal person (e.g. a corporation). Fundamental human rights are implicitly granted only to natural persons.
Prior to the American Revolution, John Locke, the philosopher of individualism, created “a passable explanation – perhaps one may call it a myth – to account for the existence of individual rights” (Russell Kirk). “All men are created equal” was a conclusion from postulating the existence of ‘mental substance’, or soul, which accompanies the ‘material substance’ of each human body from conception.
Rights attach to the individual and are recognized as pre-political in character. Locke’s’ prescription for human interaction derives from natures laws and describes liberty in ‘negative’ or restrictive terms. This created limits upon monarchial or democratic principles for the purpose of protecting minorities – preventing tyranny of the majority.
“… each man joins in society with others for the mutual protection of his life, liberty and estates…” “The … chief end … of men uniting into common wealths, and putting themselves under government, is the preservation of their property.” - Locke
Locke’s philosophy was embraced in our Declaration of Independence. He influenced the checks and balances in our Constitution. His concept of unalienable rights led to a ‘charter of negative liberties’ which formed the first ten Amendments – our Bill of Rights.
What should be the real goal of our “restoration” effort? Should our effort be defense of the Bill of Rights, restoration of the original intent behind the Constitution, or reclamation of our Rightful Liberty as understood in the Declaration of Independence?
Jeremy Bentham, an English contemporary of the American Revolution commented on law, stating: “Every law is an infraction of liberty”.
If we turn to legislative action to restore liberty, how are we different from “statists” and tyrants who coerce others to adopt their preferred culture, norms and behaviors? People who resort to statutory law and regulation are using force to manipulate other people for their own purposes.
Task:
Accept the facts of our current reality and ‘engineer’ a solution. Begin with the individual as the fundamental unit of human value. Work to diminish the power and control of the collective and the tyrant. Abandon legislative action as a means to guarantee liberty, as legal structure is only a mechanism to control others. Establish conditions that encourage a desired end-state.
“Force and conquest, in England as elsewhere, constituted the actual cement of society …” Russell Kirk, intro to Lockes’ 2nd Treatise on Civil Government
At the conclusion of the American Revolution, the “cement” of the English monarchy had been eliminated and the “bricks”, the former Colonists, embraced a philosophy of individual sovereignty within the governance of their 13 independent Republics.
But if every human is an independent and sovereign entity, to what or whom do we submit? And WHY ?
In the United States as in England, the common law derived its legitimacy from obedience to a sovereign. But in the States the people were sovereign. They consented rather than submitted to the common law. Courts transformed from being instruments of a single, distant, authoritative voice, into institutions belonging to the people, and operating by their consent.
Americans, more than the English, understood the common law to be the product of natural law and reason. In the hands of the people it was no threat to liberty. (Constitutional Rights in Common Law World – Tvrdy)
James Madison, however, (architect of the Constitution) believed that liberty required more than the mere absence of coercive authority. His vision of Liberty as a personal, social, and political ideal was dependent upon the existence of certain affirmative social and political conditions. For Madison, freedom required a social balance between diverse, often competing, social interests. (Federalist Papers 10 and 51)
Positive liberty was a form of collective regulation for a social and political world. The Madisonian concept of democracy was a ‘popular government’ in support of ‘popular sovereignty’, but was fundamentally in opposition to individualism. The distribution of power across groups and citizens was envisioned to check the influence of minority factions. Consequently the rights of the “smallest minority”, the individual, were at risk.
The Constitution was designed to not operate directly upon individual persons. Most ratifying conventions hoped the “more
perfect union” would be a minimal structure, to facilitate Jefferson’s’ procedural and instrumental legislation among the several States.
The first ten Articles of Amendment to the Constitution attempted to guarantee that natural rights of individuals would not be violated by the newly created general government. The language in the preamble to the Bill of Rights made this very clear:
“THE Conventions of a number of the States, having at the time of their adopting the Constitution, expressed a desire, in order to prevent misconstruction or abuse of its powers, that further declaratory and restrictive clauses should be added: …”
Liberty was doomed by the time the Convention of 1787 had concluded. This statement may seem to conflict with the adoption of the Bill of Rights in 1791, but in fact the BoR was an attempt to breathe liberty back into the corpse of a confederation subsumed by the new national government.
The initial influence of the new “general government” was small, however, and at the local level the people lived their lives under common law and enjoyed their “rightful liberty”.
Jefferson dismissed the “overarching social interest” expressed by Madison, stating “The rights of the whole can be no more than the sum of the rights of individuals.” From Jefferson’s’ perspective the Constitution made no provision against the destruction of liberty by factions.
What might the product of the convention of 1787 have looked like if Jefferson had not been exiled to France? What do we need to live more like Jefferson?

Part 2 In Search of Mr. Jefferson’s Liberty …
Action:
Articulate a vision of liberty for free minds and free markets. Embrace individual sovereignty and act in a consistent manner. Reject all collectivism and repel coercion from any source. Withdraw consent from legislative jurisdiction. Seek voluntary collaboration with other free men.
At the time of Jefferson, common law was the form in which Natural law was expressed and presented in the courts. It was the ‘operational’ basis of John Locke’s’ formal and abstract statements of political philosophy.
Jefferson integrated a Lockean description of negative rights into his understanding of common law and social interaction. He grouped rights into two categories: natural and unalienable – inherent in man, derived from natures’ laws; and procedural or instrumental –to preserve free government, issuing from affirmative law. An example of the first is freedom of religion; an example of the second is freedom of the press.
“Affirmative” legislation evolved to become a mechanism to provide benefits to those who consented to participate in society. Legislative law however should never violate natural law. Any positive law that violates natural law is a void law, regardless of the excuses or arguments made for its need. [Note]
An unconstitutional statute, though having the form and name of law is in reality no law, but is wholly void and ineffective for any purpose. No one Is bound to obey an unconstitutional law and no courts are bound to enforce it. (16 Am Jur 2d, Sec 177 late 2d, Sec 256)
The ‘bad seed’ of affirmative legislation had been planted. A few generations after the introduction of positive liberty came the Progressive idea that rights did not need to be regarded as pre-political checks on democratic process. Rights could be generated by affirmative legislation.
After 200 years of progressive, affirmative legislation, we live in a world of entitlements where the government expects you to believe that individual and unalienable human rights are subject to legislative enactment. Once the transfer from faith in God to reliance on the State had been accomplished, natural rights are no longer relevant.
The contemporary result is that men are now forced to pay for “social benefits” (e.g. Affordable Health Care Tax). We are bound in involuntary servitude, even though such action is expressly forbidden by the Thirteenth Amendment to our Constitution. [Note]
The decision whereby Chief Justice John Roberts declared Obamacare a “tax”, and therefore ‘constitutional’, puzzled me greatly until I discovered a passage in an obscure Senate publication from 1933 (Contracts Payable in Gold, top of pg 13):
“The ultimate ownership of all property is in the State; individual so-called “ownership” is only by virtue of Government, i.e. law, amounting to mere user; and use must be in accordance with law, and subordinate to the necessities of the State.”
This short passage exposes the perverse logic of how governments extract rent called “property tax” from people who hold no mortgages. And by extension, the tax called “Obamacare” is justified as a form of rent for the continued use of our physical persons – a property ultimately owned and operated by the State, not ourselves.
I am not sufficiently knowledgeable to provide advice regarding how to withdraw consent and challenge legislative jurisdiction. But I am persuaded from my research that there are no legislative bodies in America that have any authority to make laws, rules, or regulations that can be forced upon any free individual – absent his consent.
Any tacit consent that violates the rights of individuals is the result of fraud and deception. [Note] This is the point of departure from which we must reclaim liberty.

Part 3 In Search of Mr. Jefferson’s Liberty …
Result:
Recover Rightful Liberty through restoration of common law.
The common law is understood through “maxims of law”. These are foundational principles which cannot be lawfully violated. They are statements grounded in logic, reason, common sense, and truth. Lists of maxims are published and available. A few examples will suffice here: [Note]
• A man cannot give any thing, power or authority he does not have
• No one has the right to force an obligation on another with impunity
• The people, as individuals, in America are sovereign
• In America the government is the servant of the sovereign people
• Truth is paramount and the objective of the rules of law
• Might does not make right
• Thou shall not steal
• Thou shall not bear false witness
• A person is innocent until proven guilty
• All presumptions of law are rebuttable
• Written law cannot lawfully or morally violate rights of a free man
• Force, perjury, or subornation of perjury, voids all
The third Maxim has been a source of much debate over the years. Is sovereignty an attribute of an individual, the people as a body politic, a State as a member of the Union, or the general government?
Article IV, section 4 of the Constitution states: “The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.”
A Republic is a government in which supreme power is held by citizens entitled to vote and is exercised by elected officers and representatives governing according to law.
Our guarantee of a Republican form of government does not ascribe sovereignty to the States. Sovereignty was not delegated to the general government in the limited grant of powers enumerated in Article 1 Section 8. The supreme power, sovereignty, is retained by the people to be exercised through delegation to officers.
A citizen, as an instance of ‘the people’, has placed himself in the service and legislative jurisdiction of a government in return for protections and benefits. This involves an explicit or implicit consent which allows for encroachment or infringement upon rights.
Ultimately all powers derive from the sovereignty of the individual who may at any time withdraw consent and resume the direct enjoyment of all rights and prerogatives.
As a consequence of the first Maxim, a man at liberty under common law should be able to directly exercise the same powers that he delegates to government. No officer in our current governments would acknowledge this possibility or tolerate the act.
At liberty under common law, with a strict adherence to natural law, an individual may do with his actions, possessions, and persons, anything he may see fit, without the consent or approval of any other individual, government, or human power. [Note]
The laws of nature only constrain him insofar as he may not create damage, violate the liberty or possessions of other, or create an obvious danger. This is known as living within the common law of the land. [Note]
DHS and local law enforcement have labeled men at liberty “sovereign citizens” and claim they are a threat to peace and order – enemies of the state. The label is an oxymoron as a citizen has ceded sovereignty, and a sovereign is not bound by the obligations of citizenship.
LEO warns of anarchy and attempts to scare people from seeking and achieving Rightful Liberty. People must be educated to understand that anarchy does not happen because people violate statutory or positive law – regulation and malum prohibitum. Anarchy only happens when people violate natural law. [Note]
Logic dictates that when the maxims of law are followed, truth, justice and fairness prevail in a high percentage of cases. It is virtually impossible to manipulate maxims of law in order to create fraud or injustice in the way an attorney can manipulate statute and regulation to cause confusion and create injustice. [Note]
[Pause for effect…]
So let us reflect on the problems facing our Patriot community.
What is the primary difference today between the ‘community organizers’ who are collectivists and our efforts as individualists to organize the Patriot community? Collectivists embrace legislative force to achieve their “ends”; individualists rely upon voluntary cooperation.
Voluntarism among individuals may result in a loss of certain liberties (sovereignty), but voluntarism is elective and reversible. The Constitution was ratified by voluntary actions of representatives of nine States and, at the time, none believed their decision was irrevocable.
Can patriots learn from community organizers to achieve our goals without intrusion upon rightful liberty? Any contemporary statist, whether they call themselves Republican, conservative or constitutionalists, who endorses the use of force by the state to deliver goods and services or otherwise achieve social / political / financial outcomes, is using collective power to enslave individuals.
Over the course of the 19th and 20th centuries, government and the courts have engaged in silent judicial encroachment. They presume that all citizens have submitted their private lives, affairs, and property to the domination of government. By this presumption of law men are obligated to abide by, and be obedient to, legislation.
We have been conditioned since birth to accept and consent to some form of man made authority. Our founding fathers never dreamed that the people of today would accept feudalism without concern. [Note]
The question each of you should be asking yourself at this moment is: “Given the American proposition that sovereignty resides in the people, as individuals, from where did any legislature acquire the supreme right to make laws that can force obligations and violate the rights of private people?” [Note]
The act of withdrawing consent removes the obligation to submit to legislative authority.
Withdrawal of consent restores all that was compromised or aliened by the former social compact, parts of which were clearly implemented by fraud.
In so doing, men become morally free to resist all forms of coercion with retaliatory force – in all domains of life. To the extent of one’s courage, any man may once again enjoy rightful liberty.
“Rightful Liberty is unobstructed action according to our will within limits drawn around us by the equal rights of others. I do not add ‘within the limits of the law’ because law is often but the tyrant’s will, and always so when it violates the rights of the individual.” ~ Thomas Jefferson
The law that is often “but the tyrant’s will” is that affirmative legislation and regulation enacted to wrest control our lives, liberties and estates and fix them under legislative jurisdiction.
A return to common law is a necessary prerequisite to restore Rightful Liberty, the object and desired end-state of all free men.
Our task is to learn and practice common law among ourselves, and in defense of encroachments by collectivists and their presumption of law.
A focus on common law and Rightful Liberty will direct our attention toward what we value, and minimize “division” within the Patriot Movement.
I may continue to pay tribute /taxes to the governments that claim jurisdiction over me – but I do so at present under protest and duress.
I have begun to withdraw my consent …

If we Constitutional conservatives want to increase our seats at the table of State and Federal governments, then we must as you point out - do the work . . tell the real truth and hand it out from Precinct to Precinct town to city, city to county and counties to State Legislators and governors. Electing more and more that will use the truth talking points . . Republicans [Lincoln] freed the Slaves, the KKK was Democrats [[D] Senator Bird was a grand wizard] - it was the Republicans that provided the votes to pass the CIVIL RIGHTS BILL . . it was the Republicans that created the economic safety nets like earned income tax credits . . many many many programs to help people up the economic ladder and education reforms were Republican ideas.
The MSM will not carry the Republican message of truth so then we the people must hand it out person to person and we must educate all candidates and elected officials - we must fight the Democrat Progressive messages of racial minority hate speech directed at the Conservative Christians . . Hispanics are mostly Catholic and Blacks are mostly Baptists so when the Secular left attacks the Conservative Christian they are also assaulting the minorities are they not? We must organize and work or the "REPUBLIC" form of government of Ben Franklin will be lost and a Democracy will then slide to collapse and failure of the great American Experience. The first section of this link shows how to create a winning system.

What We Need To Do Now - Get Involved! Here's How
What we need to do as soon as possible. Why we need to do it. Why it will work. If. We. Unite. NOW!
Folks, we need to win the next round of elections, no? And we need to elect constitutional conservatives, no? Well, they need to run on a party ballot. And they have to win the primary election. And that's the EASIEST one to win because turnout is so low. If we can raise the turnout in our neighborhoods -- our "political neighborhoods" -- our precincts, we can cause constitutional conservatives to win those all-important, traditionally-very-low-turnout primary elections.
As Judson Phillips has advised, we (that means YOU and me -- each one of us) have to DO two critical things simultaneously: become precinct committeemen in the Republican Party AND become poll watchers and poll workers to make sure the vote is not stolen.
We are weakest where we should be strongest, and most of us don't know it. At the precinct level, from which all power withing the Republican Party comes, over half of the precinct committeeman slots are VACANT.
This chart shows where the real power lies.

Where all the power comes from, over half of the positions are vacant. That's where the opportunity for constitutional conservatives exists.
This next chart shows how the "power" chart should be drawn -- with the citizen on top. But the citizen has been sitting up in the bleachers for generations. We need to become ball players. And in the real ball game of politics, which is PARTY POLITICS, if you want to be on the ball field and play the game, you've got to become a precinct committeeman.

And in the real ball game of politics, which is PARTY POLITICS, if you want to be on the ball field and play the game, you've got to become a precinct committeeman.
This next chart shows that about half of the Republican Party precinct committeeman slots are vacant. And that the filled slots have been split, ideologically, about 50-50 between conservatives and Republicans In Name Only. The elections of Michael Steele as RNC Chairman, and then Reince Priebus, reflect that ideological split. In Arizona, where I live, it's been even worse. In 2008, fewer than one-third of the PC slots were filled. We are not even up to half-strength yet. But in two years we've completely changed the Party, because almost all of the new PCs are conservatives from the grass roots conservative groups. Now they are UNITING inside a real political party where they can actually BECOME the leaders of the Party and determine the outcome of the primary elections.
Here's an article about what we achieved in Maricopa County in two years by UNITING POLITICALLY INSIDE A POLITICAL PARTY:
http://www.redstate.com/coldwarrior/2011/01/24/mission-accomplished...
This next chart shows, again, that the Party is weakest where it should be strongest. All of the "upper level" officer slots are filled, but only about 44 per cent of the most important slots, the "we the people" slots, are filled. And if "we the conservative people" fill them up, we can take over the Party and determine the outcome of the elections.

This next chart shows what we have, and what we could have. Which Republican Party do you want? What will YOU DO to make the full-strength, 75 % solidly conservative landslide-win-producing political powerhouse of a party happen?
One more graphic. This one shows HOW we can get to a full-strength, solidly-conservative Republican Party IF we will all UNITE INSIDE the Republican Party as precinct committeeman. United we stand. Divided we fall. Let's unite, no?
Let's get it done, shall we? Who's with me?

HOW WE THE PEOPLE KEEP OUR REPUBLIC
Ben Franklin's response when a lady asked - what kind of government did you give us?
He said - "WE GAVE YOU A REPUBLIC IF YOU CAN KEEP IT."
Our nation has never been so close to becoming a Fascist Democracy where the government powers are consolidated in one central planning and regulating all powerful oppressive government.
What can WE THE PEOPLE do to stop this usurping of the Constitution and lording over our many States? There are so many areas of domination that action must be taken or we will have lost our Republic and States’ rights and powers. The IRS, EPA, DOE, HLS, NDAA, FDA, USDA, and the thousands of agencies that promulgate rules and regulations that have the force of law. Using the EPA clean water act and/or the Endangered Species Act these government agencies can take the use of your land to farm or build a home on away from citizens without paying a single dime to the owners.
Now we must join in our efforts across this great nation to stop the madness and take our country back. We must unite in each of the many States and go into the streets yelling "WE ARE MAD AS HELL AND WE ARE NOT TAKING IT ANYMORE" - the media, the local elected council members must be invited to help us save the Republic if they refuse then we must defeat them in the next election cycle. Next we go to the homes, businesses and offices of each and every State handing each one a copy of the ARTICLE V 28TH AMENDMENT. All citizens must inform the elected legislative representatives that they want an endorsement of the repeal amendment - that they support repealing the 14th, 16th and 17th amendments to restore the original intend of the Founders, Framers, and Ratifiers that the Federal government would be small, limited and weak - the State governments to be powerful and unlimited except as stated in the original Constitution.
Start by reading the Article V State amendment number 28 - make sure you understand the reasons for the measures.
Study the information in the site library and links - knowledge is power and this is the knowledge bank.
Email and post the site link to all you know and ask them if they will do this work to save the Republic.
Now you are prepared to do the hard work of saving our great nation for our children and the future generations; if we fail, the Republic will be buried in DEBT and will not be able to keep promises made. Those that are dependent on Government payments to live will be out in the streets like Greece, France, Spain doing great damage and causing the governments to collapse. Operating a Federal government spending more than $ 1 trillion over taxes collected is the certain road to national poverty. The current spending level will take the nation to a debt of over $ 26 Trillion and much more if interest rates are increased.
Next step is to start with some friends to form an Article V amendment group - email, phone and visit all your State Legislators and give them copies of the downloadable brochure explaining the Article V Project - pass out the brochures to neighbors and fellow church or club members. Have children do a school paper on the Constitution and the Article V project.
Always present the project and the 28th amendment as a positive grassroots method provided by the Founders to stop a runaway usurping Federal government - The Founder knew this day would come and they had faith that the new generation of Patriots would take the issue up before only a Declaration of Independence delivered to the Federal Government restoring the promised Article IV Section 4, a separate Republic for each State with all rights and powers not given to the Federal government or forbidden to the States and the following Rebellion. [This is commonly called the final Jefferson solution to usurping.]
Article 4 - The States
Section 4 - Republican Government
The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.
Keep in mind that not every Legislator must approve of our Amendment to repeal - it only take 50% plus one vote in each house of 38+ States to cause the Amendment to become law. Do not argue with any angry response, just state well we will just have to disagree on this matter. If a discussion is open then you can offer a challenger that does not agree by simply asking then what would you recommend that we do to Restore the Original Constitution and to cause the Federal government to return to the limits of the Article I section 8 enumerated powers and force the Courts back under the limits of the Article III limits?

Today's Patriots and Article V. Will Save This Nation
Today’s Patriots have been preparing to become the saving grace of this country. They have been called to do a great work. United under one political loyalty and one agenda. Love - respect - protect this Country and Restore the “America” the first Patriots fought and died for. The Liberty and Principles of their Foundation are what we are to stand upon.
A determined fellowship has joined as patriotic and concerned American citizens. We are scholars-historians-reporters-soldiers-contributors-seekers. We share ideals and hope for our Nation and Her Liberties. What is not important is who we are - what is important is what we hope to do. This site has been created and serves to educate and promote one project. Article V Project to Restore Liberty and the proposed 28th Amendment. We have become a Patriotic family and our home is here.
Our proposal:
------------------------
We ask that 38 states to agree to exercise their Article V Constitutional rights and propose an amendment to the U. S. Constitution that states:

"SO SIMPLE ONE ACTION AND DONE"
----------------------------
That's it! Explanations of why the 14th, 16th and 17th Amendments were added to the Constitution during the 1900's are detailed for you on this site. We have also provided historical information and many references that are vitally important to this effort.
It is our firm belief that without knowledge, there is no power!
This WILL save our Country!
We provide detailed information on this site regarding the Article V Project so that you may be educated and know exactly why we offer the following very simple proposal.
There is not one of us that can single handedly save this country. But, we believe there are many other brilliant and dedicated minds and hearts who will be drawn to this work. Many together can achieve this goal. Our ideals are the same - our lives independent - wherever we are - in our own circumstance - we can all be absolutely committed to restoring the founding principles that our forefathers set for us long ago.
Those ideals are timeless - they are as true today as they were when they were first penned. It is our duty, as children of Revolutionaries,to do this work. Freedom is never Free and its value only realized if it is shared and defended ….Lady Liberty is being brought to Her knees - the weight of the chains binding her low. She is asking for, and needs the help of so many.
Times they are swiftly changing…and everyday we seek to decipher and offer a meaning…to the events that are happening. We all search for a direction that is hopeful. It is our true conviction that as more and more disheartened and disappointed people look to find a place of ideas; where solutions can be advanced to save our Nation they will find a home with hope at Article V Project To Restore Liberty. We may never convert the masses who only seek to have “another” give them hope (an easy, free, personally - diminishing benefactor)…but inside the walls of this project is a place where the HOPEFUL can still come…and offer a strong back and a shared fire in their hearts to rebuild our Country.
History is being recorded and made every day - new history. We grow more troubled and concerned with the current direction of events. True news and the sources to find and search for it are not on our televisions or in our newspapers
How we as a Country have developed our policies, the memories and the documents, the heroes and the Founders, the epic of how and why we are the greatest Nation that has ever existed - this is our Nation's old history.
It is being re-written and revised by progressive efforts in our media and our institutions of learning. Old history has the lessons - and is the compass where new history should anchor itself.
What history will we allow our children to learn? It is our sacred duty to protect the true history of our Country. This true recording is spoken of reverently and respected here. We offer what we feel proudly, is the most extensive Constitutional and political documents library on the web.
True history - the telling and recording of it, the values of the lessons, is in danger. We fear the “old” will not be long remembered and the “new” is in service to the destruction of all the common struggles, sacrifice, and dreams our ancestors built. Here we all can seek and learn the true telling of the Founders vision and how government and politicians have worked to violate that vision.
Long ago, people the same as you and I saw the history of their day being written in ways and in a direction they could no longer accept. Normal people from all walks of life stepped forward to become something more. They were the first true patriots. If you are here, you can also be a Patriot of today.
The same failings of oppressive government, on a much greater destructive scale; exist in America today. The government that threatens our liberties does not exist an ocean and months of travel away, yet it seems the chasm of difference between those who govern and we who are governed is wider than the Atlantic. The government and the people share the same land but do not share the same principles anymore.
Destiny is calling for us in this time just the same as it echoed so long ago for them. What is the HISTORY we will record? Will the hope of freedom and a better life be the continued dream that is America?
We believe that if we join and work together we can accomplish the education and advancement of ideas; and the necessary work that will save our Nation. We set out the welcome mat to all who wish to join us in this cause… we will continue to offer hope and lay the building-blocks that give us a workable hope for the future.
We hope to show young minds how much we respect, understand and wish to teach our history. It will help them prepare and have the knowledge to assume the responsibility that is theirs. May we always cherish and be committed to the future history we wish to make for America. We have the legacy of America to protect…the legacy of Her Future to guarantee.
This is a "call to arms!" ladies and gentlemen. We believe today’s Patriots have the heart to do what must be done. Here we can all share and gain the wisdom and the knowledge to know how it must be done. We have the clear vision to see and the earnest hearts open to hear the plea of Lady Liberty. With humility and conviction, may we join hands one-to-one and stand as many to accomplish a great work.
We believe we are the Patriots that will save this Nation once again. Article V. and Restoration of State Powers is the axe that will bring the beanstalk down. May the giant FALL!! .
We care not that history will remember us, but we pray that it will remember what we do - and that "IT" made the difference.
Thank you.
Amendment 28 - 14th, 16th and 17th Amendment Repealed
1. The fourteenth, the sixteenth, and the seventeenth articles of amendment to the Constitution of the United States are hereby repealed.
2. The article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by conventions in the several States, as provided in the Constitution, within seven years from the date of the submission hereof to the States by the Congress.

My mind and my heart took parallel journeys today. My thoughts and my feelings were in similar turmoil.
I watch the news each and every day - and in every way I know our government is broken and it affects everything in my life. I see our 'leaders' and all that they say and do, and I fear 'to where' will they lead us? I wonder if others feel as I do...life has a strange and out-of-control detachment. On one-hand, I focus very closely on all the things most important to me in my life. My family and our circumstances and how I can positively affect all that concerns us. This is as it should be and is the righteous hand. On the other hand I feel, for a desperate moment, a helpless deformity. There is little alone that I can any longer control - or change - or do to shape the direction or the outcome of what I wish to reach for. I long for different times and different direction, and for the saddest of moments I truly know that what I am wishing for is….the past - and looking at our future with dread. Is this really how a 'free people' are supposed to evaluate the state of their experience?
"Now is the time when all good men should come to the aid of their country." I wonder when Patrick Henry said that - if he worried that anyone might be listening? I wonder how the first patriots watched the events of their day, questions of liberties lost - invasions so complete into lives that their very existence and happiness became affected by a government that infringed upon them in every way - everyday. At what point did they finally chose to act? When did it become no longer bearable to live under the yoke of such tyranny? It certainly was oppression much more effective than a cup of tea. Clear eyes...focused eyes...look at all you might not wish to see...in Our Country today.....
I realized that there are two frames of reference that mark my attitude. Time when I felt all things were possible - and time where I realized the possibilities are finite. The time when I knew America was an 'ideal' - and the time when all I hear is that America is less than ideal. The time when I understood people believed in values that led to greatness in all things and as individuals these were principles to which we should all aspire - and the time when talk of greatness beyond or by an individual is thought to be an insult to the collective. What used to be 'right' now is considered 'wrong' and so many wrongs are somehow made right. Time that used to be anticipated and filled with potential and imagination by every man woman and child are approached with cautioned spirit toward what will come next and what possibilities may be gone forever.
Ladies and Gentlemen, our timeline is the same as all the great civilizations that have existed and failed throughout the annals of historical recording... are we are seeing the decline of America? Many do not want to look – do not want to accept – do not want to consider – do not want to know – do not want to address the state of affairs. Never before in our history has it been even conceivable that the best was not yet to come! Today we are being told...we are moving toward a 'new normal' and somehow that sounds dire in our expectation of acceptance. Well, whether you choose to look or not to look - the facts remain the same and the truth of such will still be endured - by each and every one of us. The decline of America is inevitable...unless we can 'somehow' capture enough hearts and minds to join this effort.
"They who cannot remember the past...are condemned to repeat it." ~George Santayana. Now is the time - once again - for all good men/women of every stripe and circumstance - to come to the aid of their country.
This is a time of URGENCY. What more must happen/will happen...before there are enough people who come to the conclusion that THEY HAVE HAD ENOUGH?
My mind stopped at this question. My heart stopped here fearing the answer to the same question. I sat and looked at the books on the table in front of me. My Bible, my histories, my copies of the Founding documents and on the shelf beside me, my photo albums of family and their framed pictures also on display. The TV long had been turned off. I can watch little anymore and trust even less. So I study...those documents, histories and the Bible and again at this site. I have to know that I am doing SOMETHING...that I am trying to be the citizen my forefathers hoped I would be. The patriot of modern times, I know my Country needs me to be. The steward and caretaker my grandchildren pray I will be - though they are too young to know they will yet say that prayer. That is the weight of this responsibility. The future of this Nation and of all of our Children who will inherit it depend on this generation to take action. Not enough of us are paying attention...not enough...not enough...
This is a time of URGENCY..... What more must happen/will happen...before there are enough people who come to the conclusion that THEY TOO......HAVE HAD ENOUGH............?
It is my most sincere prayer that it will happen soon...and that there will be many - and through them many more - who find their way here....

THE CALL TO SERVE SOMETHING GREATER
The Call to serve Something so Much Greater than yourself. It is a core belief - it is unselfish - it goes beyond all personal thought or aspiration. The stories of persons jumping in to save a drowning child - placing their own safety at risk - they jump in anyway. It is the donations of those who can little afford - and they go without in order to help provide for one more in need than they. It is the family who gives in a time of great sorrow to the transplant recipient hoping for the gift of life. It is the Navy seal who disobeys orders to save fellow Americans whose lives are in peril and in doing so sacrifices his own.
Fellow Americans - the conditions developing in our Nation today are shouting for our attention. Each on its own has value, and merit, and urgency. Combined - the noise is deafening. Combined efforts and causes are powerful beyond measure. The 'call' that we all need to hear, and find the conviction to act and pledge an answer to is this: 'In whatever capacity and to the greatest degree each and every one of us can give - are we willing to give, as the citizens that forged our Nation gave so long ago?

America is the whole of who we all are and what we as a Nation aspire to be. One-by-one-by-one by one…. America is Greater than we as individuals stand and America is calling us to unite and serve. We must find the best and most successful option available to us. The option that is lawful and peaceful and perfect. There is one solution to complete this task. There is one method that is perfect to answer the problems of this time in America. The solution comes from the Constitution - the process provided in the Constitution - and the method is given freely to the people of America to find the wisdom to do so. The Founders gave us this Country. Article V Project To Restore Liberty and the proposed 28th Amendment are the perfect solution in this time of our Nation's perfect storm. It is up to 'We The People' to find the will and the desire to unite.
Our government is broken. The leaders of our country no longer serve us. The government today increasingly makes servants of us. The slave has now become the master; and if we do not act imperatively with the liberties we still have - those liberties will disappear and the chains will become immovable. We must choose. Do we accept the yoke of government bondage? Or do we insist on reigning in a government out-of-control that is unable and unwilling to restrict itself. Look at the elephant in the room - its name is 'TYRANNY'. WE NO LONGER HAVE THE LUXURY OF TIME OR ANOTHER ELECTION to ignore this fact.

May we begin the work that needs to be done together? Listen closely in the still of an evening - safe and secure in your home or neighborhood. When you think of the value of the feelings in your heart and the hope of your thoughts and imagination...the sound you hear that breaks the peace of your comfort is Lady Liberty begging for her citizens to unite and remember what being an American really means and knowing her fear that we all stand to lose the dream that has always been hers.
There is No week, Nor day, Nor Hour...
When Tyranny may not enter Upon this Country.
If 'The People' lose their Roughness and Spirit of Defiance...
The Genius of the United States,
Is not the best or most in its executives or legislatures,
Nor it's ambassadors, or colleges, or churches,
Or it's parlors, nor even in its newspapers or inventors...
But always most...IN THE COMMON PEOPLE...
The UNITED STATES THEMSELVES...
Are Essentially the GREATEST POEM...
